Top 10 DUI / DWI tips:
- Pull over in a safe area, as soon as it is reasonable and safe to do so.
- Remember to be polite to police officers. You gain nothing by being belligerent.
- You have the right to refrain from answering any and all questions that might incriminate you. You are required to provide your license and registration. However, DO NOT tell the officer how many drinks you had.
- Obey officers’ commands. Officers may order you to get out of the car, and refusing to do so can get you arrested.
- You are NOT required to complete any field sobriety tests.
- You DO NOT need to consent to the field breathalyzer test. However, if you do refuse then you will automatically face a 6 month license suspension.
- When refusing a test or questioning by the officer all that you need to say is “On the advice of my attorney, I respectfully decline.”
- Usually you are being recorded so it is always important to be professional, respectful and say as little as possible.
- In order to search your vehicle, officers need a warrant. Officers cannot force you to say or do anything that may cause you to incriminate yourself.
